1. About Spillion

Spillion (“we”, “us”, the “Platform”) is an online marketplace that helps people in South Africa find and connect with independent tradespeople and home-service providers (“Pros”). Spillion is a connection platform only. We do not employ Pros, we do not perform any work, and we are not a party to any agreement reached between a customer and a Pro.

2. How it works

Customers send job requests to Pros. A Pro may accept or decline. If accepted, the two of you can chat on the Platform to arrange the work. Any agreement on scope, price, timing and payment is made directly between the customer and the Pro. Spillion does not currently process payments and is not responsible for the work, its quality, its safety, or any payment between the parties.

3. Eligibility & your account

You must be at least 18 and able to enter into a binding agreement. You agree to provide accurate information and to keep your account secure. You are responsible for activity under your account. Pros are responsible for holding any licences, registrations, insurance or certificates of compliance required by law for their trade.

4. Verification badge

A “Verified” badge means we performed a basic check of the documents a Pro submitted. It is not a guarantee of a Pro's competence, conduct, licensing or the quality or safety of their work. Always satisfy yourself that a Pro is suitable before engaging them, and request proof of qualifications and insurance where relevant.

5. Reviews & reputation

Reviews may only be left for a job that was marked complete, and must be genuine, lawful and based on real experience. We may remove reviews or content that is false, defamatory, abusive or otherwise breaches these Terms. Both customers and Pros may be rated; a rating forms part of your reputation on the Platform.

6. Acceptable use

You agree not to: post false or misleading information; harass, defraud or harm any person; circumvent the Platform to evade fees or safeguards; scrape or misuse data; or use Spillion for anything unlawful. We may suspend or terminate accounts that breach these Terms.

7. Disclaimers & liability

The Platform is provided “as is”. To the maximum extent permitted by law, Spillion is not liable for any loss, damage, injury or dispute arising from your dealings with a Pro or customer, the performance or non-performance of any work, or any payment between the parties. Nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008 (“CPA”) or other South African law that cannot lawfully be excluded.

8. Privacy

We process personal information in line with the Protection of Personal Information Act 4 of 2013 (“POPIA”). Please read our Privacy Policy, which forms part of these Terms.

9. Electronic transactions

By using Spillion you consent to transacting electronically under the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”). Electronic records and communications have the same effect as if they were in writing.

10. Changes & governing law

We may update these Terms; material changes will be posted here. These Terms are governed by the laws of the Republic of South Africa.
